Terms of Use

Filomy (filomy.com) is a platform for creating memories and collaborative spaces, allowing its users to: 100% free products, with no limit: — Set up birthday reminders and send personalised e-cards to loved ones (D‑7 and D‑1 reminders, AI suggestions); — Create an online group fund with no commission to finance a group gift, a trip or any shared project; — Create a group gift voucher (a simplified version of the group fund with a target amount and a personalised message); — Generate personalised cards (message, photo, audio or video, shared via QR code or link). Freemium products (then a €39.90 activation code for unlimited use): — Create collaborative memory spaces (digital guest books) for occasions such as birthdays, weddings, retirements or births; — Set up time capsules (scheduled messages sent to a future date); — Create and manage event invitations with RSVP tracking; — Generate a memory book (a collaborative illustrated biography) — the freemium version cannot be shared and has no PDF or video export; the activation code unlocks sharing and export. — Create online surveys (single or multiple choice, scale, open answers, conditional questions; anonymous or named answers) — the freemium version is limited to 50 responses and 3 months; the activation code unlocks unlimited responses and sending the results to participants. — Create online polls (single or multiple choice, scale, open answers, conditional questions; anonymous or named responses) — the freemium version is limited to 50 responses and 3 months; the activation code unlocks unlimited responses and sending the results to participants. — Offer collections from a mini-site: free-amount contribution, priced questions or stay (nights and meals, several participants per registration), with ready-made templates and tracking of payments declared offline (bank transfer, Wero, cash…) or, where available, by card — the free version is limited to 50 responses per collection; a premium mini-site (unlocked, or created with a paid Box) or a Pro Space account makes responses unlimited. Freemium products (then a €9.90/month subscription): — Create a private Family Wall to share photos, videos and milestones with loved ones via email notifications, with no social network; — Create a Seniors' Wall to keep a digital connection with the older members of the family; — Organise a collaborative birthday wall allowing a group to track and celebrate its members' important dates. Products reserved for the Pro Space subscription (€39.90/month, professionals): — Create one or more professional mini-sites under your brand, bringing together your Filomy spaces and products on a page shareable via QR code. The subscription includes unlimited contributors per mini-site and the opening of up to 5 mini-sites at the same time; a closed mini-site becomes read-only and frees up a slot (see article 9). The purpose of these terms of use (ToU) is to define the rights and obligations of Filomy and of each user in connection with the use of the service.

Access to the creation of memory spaces, memory books and time capsules requires the creation of an account. Registration requires a valid email address. A magic sign-in link (passwordless) is sent to this address to authenticate the user. The account is strictly personal and non-transferable. The user is solely responsible for keeping their access details confidential and for any activity carried out from their account. They undertake to inform Filomy without delay of any unauthorised use at bonjour@filomy.com. Filomy reserves the right to refuse or delete an account that does not comply with these ToU.

The user remains the owner of all the content they publish on Filomy (texts, photos, audio messages, videos, etc.). By publishing this content, the user grants Filomy a non-exclusive, worldwide, free licence, for the time needed to provide the service, for the following sole purposes: hosting, display to invited people, generation of the memory book or memory box, and sending of birthday reminders. Filomy does not use user content for commercial or advertising purposes, or to train artificial-intelligence models, without the user's prior agreement. The user warrants that they hold the necessary rights to the published content (in particular photographs involving third parties) and that they are not infringing the intellectual property rights or privacy of third parties.

It is strictly prohibited to publish on Filomy content that is: — Unlawful, contrary to public order or to accepted standards of decency; — Harmful to the privacy, image or dignity of third parties; — An infringement of third parties' intellectual property rights; — Hateful, discriminatory, violent or pornographic in nature; — Containing third parties' personal data without their prior consent; — Constituting spam, disinformation or unsolicited advertising. Filomy reserves the right to remove any manifestly unlawful content and to inform the competent authorities if necessary.

Deletion on request: the user can delete their account at any time directly from their dashboard (Profile tab → Delete my account) or by writing to bonjour@filomy.com. Deletion is immediate; order data is anonymised (legal obligations — 10 years, Art. L. 123-22). Automatic deletion for inactivity: in accordance with the GDPR and the CNIL's recommendations, any account inactive for 3 years receives a warning email 2 months before deletion. Without a new login within that period, the account and all its data are automatically deleted. Termination by Filomy: Filomy may suspend or terminate an account without notice in the event of a serious breach of these ToU, fraudulent behaviour or infringement of third parties' rights. An email notification will be sent to the user. In the event of a suspension due to an error by Filomy, any amounts owed will be refunded on a pro rata basis.

Filomy uses all reasonable means to ensure the availability and security of the service. However, Filomy cannot guarantee the absence of interruptions due to maintenance operations, technical incidents or external causes (network outages, force majeure). Filomy cannot be held liable for any indirect damage resulting from the use of, or the inability to use, the service, nor for the content published by users. Filomy's liability cannot exceed the amount paid by the user during the 12 months preceding the alleged damage. Regarding time capsules: Filomy undertakes to send the messages on the scheduled date but cannot be held liable for failures related to account deletion, an invalid email address, network outages or any other case of force majeure. The detailed conditions are set out in article 12 of the Terms of Sale (filomy.com/cgv).

Filomy uses specialised providers to deliver certain features of the service. Using Filomy implies acceptance of the terms of use of these partners for the features concerned: Gelato AS (print-on-demand printing — pre-existing orders only) Filomy no longer sells new physical products via Gelato. Gelato now intervenes only to fulfil physical orders placed before this change; for those orders, Filomy transmitted to it the data needed for production (personalised PDF, delivery address, contact details). Gelato is subject to its own general terms, available at gelato.com. Stripe (online payment) Provider handling card payment processing. Filomy stores no card data; it is processed exclusively by Stripe, PCI-DSS Level 1 certified. Anthropic (artificial intelligence — writing assistance) Claude model used for the writing-assistance features for cards and spaces (message suggestions, profile analysis). Only the content you enter in these specific fields is transmitted. OpenAI (artificial intelligence — memory book) GPT-4o model used to automatically generate the memory book's structure (title, thematic chapters, introduction, conclusion) from the collected contributions. Only the excerpts of contributions you have approved are transmitted to OpenAI at this stage. Use is optional; you can choose a manual structure without using this feature. OpenAI is subject to its own terms of use, available at openai.com. Canva (single-unit printing) For printing a single card, Filomy offers an optional connection to your Canva account via the official Canva Connect API (OAuth 2.0). If you choose to use this feature, Filomy generates a PDF file of your card and imports it into your personal Canva account. You then finalise the print order directly on the Canva platform, under your own responsibility. Filomy is not involved in the order transaction or the delivery. This connection is entirely optional; you can connect or disconnect at any time from your settings. Canva is subject to its own terms of use, available at canva.com. Filomy undertakes to inform users of any change of provider likely to affect the processing of their personal data.

Filomy sends transactional emails related to the status of the spaces and tools created. These are inherent to the service and do not constitute optional commercial communications: Expiry emails (freemium tools): — D‑7 before expiry: reminder that the space or tool will be set to read-only in 7 days, with a link to unlock unlimited use; — D‑1 before expiry: final reminder before switching to read-only; — Day of expiry: confirmation of the switch to read-only, data retained, link to reactivate; — D+7 after expiry: informational email about the unlocking options (activation code or subscription depending on the type of product). These emails are sent to the address associated with the account of the creator of the space or tool concerned. The user can manage their notification preferences from their dashboard.

Filomy offers two types of paid plans, depending on the product category. All are subject to the Terms of Sale (ToS) available at filomy.com/cgv. One-off activation code — €39.90 (event products) For the following products: Memory space, Time capsule, Invitations & RSVP, Memory book. An activation code unlocks the tool for unlimited use: no time limit, up to 100 participants, unlimited contributions. For the Memory book, the code also unlocks link sharing and PDF/video export. One-off payment, with no subscription or commitment. Monthly subscription — €9.90/month (continuous spaces) For the following products: Family Wall, Seniors' Wall, Birthday Wall. The subscription keeps the space active continuously for up to 100 people, with unlimited contributions. No commitment, cancellable at any time. On cancellation, the space returns to read-only mode (data retained). Pro Space subscription — €39.90/month (professionals) Reserved for professionals, the Pro Space includes the mini-site branded to you as well as all event and everyday tools without limit, with unlimited contributors per mini-site. The subscription lets you open up to 5 mini-sites at the same time. A finished mini-site can be closed at any time from the dashboard: it then becomes read-only (memories remain viewable, no new contribution is accepted) and frees up a slot to open another; a closed mini-site can be reopened as long as the limit of 5 open mini-sites is not reached. Beyond 5 mini-sites open at the same time, a bespoke offer is arranged on request at bonjour@filomy.com. No commitment, cancellable at any time; on cancellation, the mini-sites become read-only (data retained). Freemium plan (reminder) The event tools (Memory space, Invitations, Memory book) and the Walls start in a freemium version: 50 connected users, 50 contributions and 3 months of activity (cumulative limits — see article 11). The Personalised card and the Time capsule are 100% free, with no limit or expiry. Activating a code or a subscription can happen at any time, including after expiry.

Filomy reserves the right to modify these ToU at any time. In the event of a substantial change, Filomy will inform users by email at the address associated with their account, with at least 30 days' notice before the new terms take effect. Continuing to use the service after this period constitutes acceptance of the new ToU. If the user refuses the changes, they can delete their account before the effective date.

The event tools (Memory space, Invitations & RSVP, Memory book) as well as the Walls start in a freemium version. The Personalised card and the Time capsule are 100% free, with no limit or expiry. The following limits apply cumulatively to the freemium tools: — 50 users connected to the space; — 50 contributions received; — 3 months of activity from creation. The first threshold reached triggers the tool switching to read-only mode: the existing data and contributions are retained and viewable, but no new contribution is accepted. Memory book exception: the freemium version is furthermore non-shareable (the link cannot be distributed) and has no PDF or video export. Free products with no limit: Birthday reminders, Group fund, Group gift voucher and Personalised cards are subject to no limit of duration or volume. Unlocking: the tool can be brought back into service at any time by activating an activation code (€39.90) or taking out a subscription (€9.90/month for the Walls). Unlocking is without any limit of duration or contributions (see article 9). Sign-ups and collections: up to 50 responses per collection in the free version (one registration counts as one response, even for several participants; cancelled registrations are not counted). Beyond that, new registrations are suspended until the collection is upgraded to premium; responses already received are kept. The organiser is notified by email at 80% and then at 100% of the limit.

An activation code unlocks a space or event tool for unlimited use (no limit of duration or contributions; up to 500 participants for a memory space or guestbook, 100 for an event tool). For the Memory book, the code also unlocks link sharing and PDF/video export. Codes are valid for 24 months from their purchase. They are non-transferable and can only be used once.

Filomy provides a tool for organising and tracking collections; it is not a party to payments made between participants and the organiser. The organiser alone sets the services offered, their prices, the accepted payment methods and the details shown to participants (IBAN, Wero or Lydia ID, PayPal link…). The organiser warrants that they are authorised to share these details and undertakes to confirm a participation only once payment has actually been received. Participants undertake to declare a payment (“I've paid”) only once they have actually made it. A declaration is merely information passed on to the organiser, who alone decides whether the payment has been received. Offline payments (bank transfer, Wero, Lydia, PayPal, cheque, cash) are made directly between users: Filomy does not collect or hold them. Card payment, where offered, is processed by Stripe and paid into the organiser's account. Bank reconciliation: the statement imported by the organiser is not stored; only the lines confirmed as matching a participation (date, description, amount) are saved with it. Cancellations, refunds and disputes relating to the services organised are the organiser's responsibility.
